By using NiblyNotes®, you agree to the following terms. If you are still a minor, it is best to read through these points together with your parents or guardians and discuss them with them.
NiblyNotes is provided by PC-Future GmbH as a tool for notes, drawings and learning content. The app is developed with care, however, errors, data loss or unexpected behavior cannot be ruled out in every case.
App features may change, be added or be discontinued in the course of further development. No guarantee is given for uninterrupted availability – in particular of online and cloud features that depend on third-party services or an internet connection.
PC-Future GmbH is not liable for damages arising from the use of the app, in particular not for:
The limitation of liability does not apply where the law mandates liability – in particular for intent or gross negligence, for injury to life, body or health, and for the breach of essential contractual obligations.
You are responsible for creating regular backups of your content. NiblyNotes offers export and backup functions, the regular use of which is recommended.
Local backups can optionally be encrypted with a password. Keep this password safe: an encrypted backup cannot be restored without the correct password, and PC-Future GmbH can neither decrypt nor restore it.
NiblyNotes stores your notebooks as well as access credentials for connected services (for example cloud storage) on your device. To keep this data protected, you should set up a device passcode (PIN or password) and – where available – Face ID or Touch ID on your iPad. You should also keep your device's operating system up to date so that known security vulnerabilities are fixed.
Without a device passcode, anyone with brief access to your unlocked iPad can view or modify your notebooks and the cloud content connected through the app. In addition, without a passcode the operating system does not store the data in encrypted form.
You – or, for minors, the parents/guardians or the school – are responsible for setting up a device passcode and for protecting the device against unauthorized access, loss or theft. PC-Future GmbH is not liable for damages resulting from no device passcode being set or from the device being made accessible to unauthorized third parties.
On modified devices (for example with a "jailbreak"), the operating system's security and encryption mechanisms are no longer guaranteed. No warranty is given for using NiblyNotes on such devices, and there is no liability for any resulting damages.
When using the classroom mode, data is transmitted directly over the local network. The teacher or school is responsible for the security of the network used and for lawful use in an educational context.
In compatibility mode, the teacher's device runs a local web server through which students who do not have the NiblyNotes app installed can access the provided content (PDF and images) via a browser on the same Wi-Fi network. Access is protected by a daily password. The teacher or school using the app is responsible for the security of the network, for the suitability of the content for the respective class, and for lawful use.
When using the student notebooks feature, notebook pages and annotations are transmitted to a server in encrypted form. Encryption happens end-to-end on the iPad – the server cannot read the content. The teacher or school is responsible for obtaining the consent required by data protection law (in particular for minors) and for the selection of a suitable server. Uploaded data is automatically deleted from the server after 21 days of inactivity.
NiblyNotes can be connected to external services, such as cloud storage like Nextcloud, the Bayerncloud (ByCS) or Apple iCloud, in order to back up or transfer notebooks. These services are not operated by PC-Future GmbH. The respective provider is solely responsible for their availability, security, data processing and terms of service; the person using the app or the school is responsible for selecting a suitable and data-protection-compliant service. PC-Future GmbH is not liable for damages arising from the use of connected third-party services.
NiblyNotes allows you to embed external content – in particular videos from platforms such as YouTube – into a notebook. This content is not provided by PC-Future GmbH, but is fetched directly from the respective provider. When playing, your iPad establishes a connection to the provider and transmits data (in particular your IP address). The respective provider is solely responsible for content, availability, advertising and data processing.
PC-Future GmbH has no influence over whether a linked video remains available, what content is shown before or after the video, or what data the provider collects. When embedding external videos in a school setting, the teacher or school using the app is responsible for reviewing the content for suitability beforehand and for ensuring the necessary data-protection requirements are met.
You are responsible for the content you create, import, embed or share in NiblyNotes. Make sure you hold the necessary rights – in particular copyright, usage and personality rights – when you use or share images, texts, documents or other content created by others. PC-Future GmbH is not liable for any infringements arising from the content you add or share.
NiblyNotes may only be used for lawful purposes. In particular, it is prohibited to create, store or share unlawful, insulting, violence-glorifying, pornographic content or content that infringes the rights of others.

All other product, company and brand names mentioned – in particular Apple, Face ID, Touch ID and iCloud (Apple Inc.), Nextcloud (Nextcloud GmbH), ByCS / BayernCloud Schule and NetMan for Schools – are trademarks or registered trademarks of their respective owners and are used here for descriptive purposes only. PC-Future GmbH has no business relationship with these companies and is neither endorsed nor sponsored by them.
Should individual provisions of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory regulation.
